Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Shooter mobile application (the “App”), operated by Kennedy Development Group, LLC (“we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Informational Use Only
The App provides ballistic calculations, firearm-related data storage, and related tools for informational and planning purposes only.
All calculations, outputs, and information provided by the App are estimates based on user-supplied data, assumptions, and reference sources. The App is not a substitute for real-world testing, professional judgment, or safe firearm handling practices.
2. Assumption of Risk
Use of the App involves inherent risks, including risks associated with firearms, ammunition, ballistic activities, and reliance on calculated data.
By using the App, you knowingly and voluntarily assume all risks associated with its use, including but not limited to property damage, personal injury, serious injury, or death.
3. User Responsibility
You are solely responsible for:
- Verifying all ballistic data through real-world testing
- Safe handling, storage, and use of firearms and ammunition
- Compliance with all applicable local, state, federal, and international laws
- Any actions taken based on information provided by the App
The App does not provide legal advice, safety instruction, training, or certification of any kind.
4. Accounts and Access
Certain features of the Service, including cloud synchronization and the web portal, require you to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use or suspected security breach.
We are not responsible for any loss or damage arising from unauthorized access to your account due to your failure to safeguard your credentials.
5. No Warranties
The App is provided “as is” and “as available,” without warranties of any kind, express or implied.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, and availability.
We do not warrant that the App will be error-free, uninterrupted, or produce accurate results.
6. Limitation of Liability
To the maximum extent permitted by law, Kennedy Development Group, LLC, its owners, officers, employees, contractors, and developers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the App.
This includes, without limitation, damages for personal injury, death, property damage, lost profits, lost data, legal claims, or any other losses, even if we have been advised of the possibility of such damages.
Your sole remedy for dissatisfaction with the App is to stop using it.
7. Indemnification
You agree to defend, indemnify, and hold harmless Kennedy Development Group, LLC and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the App
- Your violation of these Terms
- Your misuse of firearms or reliance on App data
- Your violation of any law or third-party rights
8. Third-Party Services
The Service may integrate or link to third-party services, tools, or websites. We are not responsible for the content, accuracy, or practices of any third-party services.
Your use of third-party services is subject to their respective terms and policies.
9. Changes to the App or Terms
We may modify or discontinue the App at any time, with or without notice.
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
11. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
